Terms and Conditions of Sale for Merion IT LLC

1. Orders: All orders are subject to acceptance by Merion IT LLC. An order is not considered accepted until it is confirmed by Merion IT LLC in writing.

2. Prices: All prices are quoted in U.S. dollars and are subject to change without notice. Prices do not include any sales, use, or other taxes or duties imposed by any taxing authority. All such taxes and duties are the responsibility of the purchaser.

3. Payment: Payment is due in full at the time of purchase. We accept payment by cash, check or credit card.

4. Shipping: All products are shipped FOB shipping point, which means that the purchaser assumes all risk of loss or damage during shipping. Shipping and handling charges are the responsibility of the purchaser.

5. Limited Warranty: Merion IT LLC warrants that its products will be free from defects in material and workmanship for a period of 90 days from the date of delivery. This warranty does not cover damage resulting from misuse, abuse, or neglect. Merion IT LLC's sole obligation under this warranty is to repair or replace any product found to be defective within the warranty period.

6. Limitation of Liability: Merion IT LLC shall not be liable for any damages of any kind arising from the use of its products, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

7. Returns: All returns must be authorized in writing by Merion IT LLC. Products returned for any reason other than defects will be subject to a restocking fee of 35% of the purchase price. Shipping charges for returned products are the responsibility of the purchaser.

8. Force Majeure: Merion IT LLC shall not be liable for any failure to perform due to circumstances beyond its reasonable control, including but not limited to acts of God, war, riot, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

9. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Pennsylvania. Any legal action arising out of or relating to this Agreement shall be brought in the state or federal courts located in Pennsylvania, United States of America.

10. Entire Agreement: This Agreement constitutes the entire agreement between the purchaser and Merion IT LLC with respect to the sale of products and services.

11. Amendments: Merion IT LLC reserves the right to modify these terms and conditions at any time. The latest version of the terms and conditions will be posted on the Merion IT LLC website.

By placing an order, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions. If you do not agree to these terms and conditions, please do not place an order.
